By participating in the Contest, you agree to be bound by these Terms & Conditions and represent that you satisfy all of the eligibility requirements set out herein below.

1) Eligibility: To participate in this contest, passengers need to fill in the online contest form with correct and complete details. The eligibility to participate in the contest is to fly on Jet Airways flight between 1st Nov -31st Dec08. The age group of the participant should be between 5 to 16 years.

2) Contest Period: Entry to the contest closes on 31st December 2008 at 2400 hours, Indian Standard Time.

3) The prize winner will be decided at the end of the promotion by Jet Airways (India) Ltd and Disney. Winners will be selected on the basis of a random draw.

4) The winner will be entitled to the mentioned prizes of the contest, subject to applicable terms & conditions.

5) Restrictions and Exclusions for Bumper Prize. The grand Prize Winner and his/her accompanies (if any) shall be solely responsible to possess and own all the necessary documents required to travel to the prize venue, which includes valid passport and visa requirements. The Prize packages are non-transferable, may not be exchanged for cash. The hotels and the flights to prize venue are subject to availability at the time of making the booking. The Bumper Prize shall exclude all airport taxes, airport security charges and incidental expenses at the hotel and/or during the trip (e.g. tips, meals, telephone, laundry, room service charges, beverages charges {alcoholic or non-alcoholic} merchandise purchases). JET AIRWAYS shall not be responsible or liable to the grand Prize Winner and/or his/her accompanies (if any) in the event the grand Prize Winner and/or his/her accompanies (if any) are denied entry to the prize venue for any reason whatsoever. Grand Prize Winner and his/her accompanies (if any) are also responsible for obtaining their own travel insurance. Prizes and/or Grand Prizes returned as undeliverable or otherwise not claimed within seven (7) days after delivery of notification will be forfeited and awarded to an alternate winner unless otherwise stated.

6) JET AIRWAYS reserves the right to substitute a Prize of equal value for any Prize. All Prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). In the event any of the Grand Prize Winner do not accept or agree to the terms as stated below, the Bumper Prize shall remain with JET AIRWAYS who on its sole discretion may offer the same to the next eligible winner. 

7) Taxes. All federal, state and local taxes associated with the receipt or use of any Prize stated hereinabove are the sole responsibility of the winners. Winners will be solely responsible for all shipping, handling, insurance and transportation costs associated with delivery of any prize.

8) Contest Rules. The Winners will be notified by post, email and/or by telephone. To claim a Prize, Winners should follow the instructions contained in their notification. JET AIRWAYS accepts no responsibility for any variation in the value of any Prize (or any part of it). JET AIRWAYS reserves the right to substitute any Prize (or any part of it) for an item of similar value. Winners will be directly contacted by Jet Airways (India) Ltd. The decision of Jet Airways (India) Ltd. will be final and binding and is non-contestable.

9) Prize Selection. The prize selection for the Contest will take place at the registered address of JET AIRWAYS. The judges appointed by JET AIRWAYS may determine the correctness, quality and validity of the entries in their sole discretion. The judges' decision will be final and binding and no correspondence will be entered into about the Contest or the judges' decision(s).

10) Disclaimer. JET AIRWAYS, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of JET AIRWAYS; or (d) any printing or typographical errors in any materials associated with the Contest. To the extent permitted by law, Jet Airways (India) Ltd. makes no representations or warranties as to the quality, suitability or merchantability of any prize.

11) Jet Airways (India) Ltd. shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered as a result of participating in the contest or using any prize.

12) Acceptance of a prize by the winner constitutes permission for Jet Airways (India) Ltd. to use the Winner's name, picture, likeness, voice and comments for advertising and promotional purposes in any media worldwide without paying any additional compensation whatsoever to the winner.

13) All entrants to the contest waive any and all rights of claim with regards to the contest against Jet Airways (India) Ltd.

14) Termination/Suspension.  JET AIRWAYS has the sole right to suspend, postpone, cease, close or terminate this Contest at any given point of time at its sole option and discretion.

15) All disputes are subject to the exclusive jurisdiction of courts of Mumbai.

16) Employees of Jet Airways (India) Ltd. or relatives & family members of employees of Jet Airways (India) Ltd. , will not be eligible to participate in this contest.

17) JET AIRWAYS Ownership of Entries. All entries and materials submitted to JET AIRWAYS in connection with the Contest (collectively, "Entry Materials"), along with all copyright, trademark and other proprietary rights associated therewith, become the property of JET AIRWAYS upon submission, and Entry Materials will not be returned to any entrant. Without limiting the generality of the foregoing, you acknowledge that JET AIRWAYS will own all rights to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and non-commercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to you or any other person or entity. You agree to take, at JET Airway’s expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by JET AIRWAYS to effect, perfect or confirm JET Airway’s ownership rights as set forth above in this paragraph 12.

18)  Affidavit & Release. As a condition of being awarded any prize, winners will be required to execute and deliver to JET AIRWAYS a signed affidavit of eligibility and acceptance of these Terms & Conditions and release of liability.
